 Our intention is to provide services that improve your wellbeing. To have a clear understanding about this exchange, we have the following terms of service in place.

1. Interpretation and Definitions

Interpretation
The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions
For the purposes of these Terms of Service:
·       “Activities” means the exercises performed.
·       “Administration Fee” means the fee incurred for any expenses incurred as a result of changes or cancellation of your booking.
·       “Bespoke Services” refer to private IDWellness services tailored to an individuals needs and goals.
·       “Bespoke Programmes” means our 5-15 week programmes, which combine our modalities to assist you in specific areas such as stress relief, pregnancy or fulfilment. These are designed on a 1:1 basis tailored and explored according to your needs and goals.
·       “Booking” means the booking of any IDWellness service and the confirmation of acceptance of that booking by IDWellness.
·       “Claim” includes but is not limited to any and all liabilities, claims, demands, expenses, fees, legal actions, rights of actions for damages, personal injury, mental suffering and distress, or death that you may suffer, your spouse, children or unborn child may suffer (including any legal fees or expenses) in connection with participation in any Activity.
·      “Client”, “Consumer” or “You” means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
·       “Class” or “Session” is any session provided by IDWellness offering one of our holistic modalities such as yoga.
·       “Corporate Wellness” means any services we offer to a company, business or group. This includes offering our IDWellness Membership as a corporate package, classes or workshops in person or online.
·       “DBS” means Disclosure and Barring Service (Basic and Enhanced)
·       “Deposit” means the money to be paid to secure your booking.
·       “Gifting Services” are any of the gifting services we offer.
·       “Events” means an extended class or session. These classes include a variety of modalities.
·       “IDWellness” refers to the wellness services provided by Isabel Daniella Lancaster.
·       “Intellectual Property” means rights to inventions; copyright and related rights; trademarks, trade names, domain names, rights in get-up, rights to use and exploit, goodwill and the right to sue for passing off; unfair competition rights; rights in designs; all rights whatsoever in computer programs, firmware, ‘apps’ and other computer software and data; database rights; and any other intellectual property rights, in each case whether registered or unregistered and including all applications (or rights to apply) for and to be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world.
·       “Issi Daniella”, “Issi”, “Isabel” and other alias’ all refer to Isabel Daniella Lancaster.
·       “IDWellness Practitioners” means Isabel Daniella Lancaster and other practitioners instructing and performing modalities as part of an IDWellness service.
·       “IDWellness Modalities” means Yoga, Pilates, Pregnancy and Postnatal Yoga, Sound Healing, Life Coaching, Breathwork, Meditation and Chanting.
·       “Our”, “Us” and “We” refer to Isabel Daniella Lancaster and IDWellness.
·       “Private Sessions” refer to private sessions on a 1:1  or 2:1 basis.
·       “Retreat” means an event held over 1 – 14 days incorporating our modalities such as Yoga or Pilates. Retreats can be held in a variety of places, including abroad.
·       “Sample Classes” means classes offered on our website free of charge.
·       “Service” refers to any offering from IDWellness. This includes;
1. All IDWellness Memberships (Basic Membership and Supportive Membership)
2.     Bespoke Services (Private Sessions and Bespoke Programmes)
3.     Gifting Services
4.      Corporate Wellness
5.     Retreats
6.     Classes, Masterclasses, Workshops, Events, Gifting Services
7.     Usage of website
8.     Mailing List
9.     ANY other purchase from IDWellness
10.   ANY interaction with IDWellness including social media.
·       “Terms of Service” (also referred as "Terms" or “Terms of Use”) mean these Terms of Service that form the entire agreement between You and IDWellness.
·       “Third Party” refers to a person or organisation less directly involved in an IDWellness such as collaborators or other person or organisations who work with IDWellness but are not a part of IDWellness.
·       “Website” refers to [www.id-wellness.com], accessible from [www.issidaniella.com]. The Website is owned by IDWellness.
·       “Workshop” means an extended session provided by IDWellness offering one of our holistic modalities such as yoga.
·       “You”, “Consumer” or “Client” means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

2. Our Services

IDWellness offers the following wellness services:

IDWellness Virtual Studio Membership - IDWellness Virtual Studio Membership is a subscription service that provides our members with access to audio-visual content for fitness and wellness. We provide a high quality videos of yoga, pilates, meditation, breathwork and more. Membership include but are not limited to; Basic Membership, Supportive Membership and any other membership IDWellness creates.

Gifting Services - Our gifting services offer wellness experiences to individuals and groups.

In Person Classes and Masterclasses - Our In Person classes offer our services in person. These may be offered directly through IDWellness or through a third party studio or company.

Online Classes - These are classes offered by IDWellness via Zoom.

Corporate Wellness - Corporate Wellness is the services we offer to companies and businesses.

Retreats - We hold events over 1 – 14 days incorporating our modalities such as Yoga or Pilates. Retreats can be held in a variety of places, including abroad.

Usage of our Website - Visiting and using our services via our website such browsing or viewing our ‘sample classes.’

Mailing Lists - Our mailing list shares information about our modalities and services.

Any other purchase from IDWellness
Any interaction with IDWellness including social media.

3. Eligibility and Access

Our services are directed to people over eighteen (18) years of age. If you are under 18 years, you must have parental consent or supervision.

These Terms & Conditions of Use (this “Agreement”) apply to all of the products, services and websites offered by IDWellness, the mobile or tablet versions thereof, any IDWellness software, and any applications created by IDWellness whether available through a social networking site or its subsidiaries or affiliated companies. Please note that the availability of any IDWellness on a social networking site, mobile or tablet device, internet television or other technology platform does not indicate any relationship or affiliation between IDWellness and such social networking site, mobile or tablet device, or internet television or other technology platform.

4. Waiver of Liability For all IDWellness Services

i.               The following terms apply when accessing and using any IDWellness Services. These include but are not limited to;
All IDWellness Memberships, Bespoke Services (Consultations, Private Sessions and Bespoke Programmes), Classes, Masterclasses, Workshops, Events, Gifting Services, Corporate Wellness Services, Retreats, Usage of website, Mailing List, any other purchase form IDWellness and any interaction with IDWellness.
ii.              You recognise that you must be in adequate physical and mental health to participate and you have o medical condition which would prevent your full participation in these Activities. You recognize that the activities cause a physical injury or a medical condition. You understand that it is your responsibility to consult with a doctor before you participate in the Activities. If you have done so, you have taken the physician’s advice. You understand that IDWellness reserves the right to refuse your participation in any Activity on medical, fitness or any other grounds.
iii.            You are aware that your participation in the Activities could result in high blood pressure, fainting, heartbeat disorders, physical injury, heart attack or stroke and may aggravate re-existing injuries or conditions that you may have. You understand that you could experience muscle, back, neck and other injuries as a result of your participation in the Activities. You understand your physical limitations and you are sufficiently self-aware to stop or modify your participation in any Activity before you become injured or aggravate a pre-existing injury.
iv.             You are fully responsible for sharing any relevant medical information with Isabel Daniella Lancaster and IDWellness when attending live IDWellness services both in person and online.
v.              Isabel Daniella Lancaster and all other IDWellness Practitioners are not medical professionals and offer no medical advise or diagnosis.
vi.             All services offered by IDWellness are not a substitute for medical attention, examination, diagnosis or treatment. The services offered by IDWellness are not recommended and are not safe under certain medical conditions. IDWellness services do not replace nor suggest to replace proper medical treatment or care for any condition. 
vii.           In consideration of being permitted to participate in the Activities, you agree to assume full responsibility for any risks, injuries or damages, know or unknown, which you might incur as a result of participating in the Activities  including those which may result from the negligence of IDWellness.
viii.          In further consideration of being permitted to participate in the Activities, you may have against Isabel Daniella Lancaster, IDWellness, IDWellness Practitioners, and independent contractors that you may sustain as a result of participating in the Activities even if the Claim arises from the negligence these parties or anyone else. You agree to indemnify and hold harmless each of the following; Isabel Daniella Lancaster, IDWellness, IDWellness Practitioners, and independent contractors, from any loss, cost, or liability incurred in defending any Claim made by you or anyone making a Claim on your behalf, even if the Claim is alleged to or did result from the negligence of any of the following; Isabel Daniella Lancaster, IDWellness, IDWellness Practitioners, and independent contractors.
ix.              You, your heirs or legal representatives forever release, waive, discharge and covenant not to sue any Third Party for any Claim caused by any negligence or other acts of the following; Isabel Daniella Lancaster, IDWellness, IDWellness Practitioners, and independent contractors.
x.             You acknowledge that you have carefully read this section of the Terms of Service and fully understand its contents. You voluntarily and knowingly agree to these Terms of Service. You are aware that by accepting these Terms of Service, you are giving up substantial rights, including your right to sue and certain legal rights to your heirs, next of kin, executors, administrators and assigns may have against any Released Party.

5.     Disclaimers of Warranties and Limitations on Liability For all IDWellness Services

i.               All IDWellness Services and all content and software associated there with, or any other features or functionalities associated with the IDWellness services, are provided “as is” and “as available” with all faults and without warranty of any kind. IDWellness does not guarantee, represent, or warrant that your use of the IDWellness Membership service will be uninterrupted or error-free. IDWellness specifically disclaims liability for the use of applications, IDWellness ready devices and IDWellness and IDWellness software (including their continuing compatibility with our service).
ii.              TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAWS, IN NO EVENT SHALL IDWELLNESS OR ISABEL DANIELLA LANCASTER BE LIABLE FOR (JOINTLY OR SEVERALLY) TO YOU FOR YOUR PERSONAL INJURY OR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER RESULTING IN YOUR ACCESS OR USE OF THE IDWELLNESS MEMBERSHIP SERVICE.
iii.            SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. THEREFORE, SOME OF THE ABOVE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.
iv.             NOTHING IN THESE TERMS OF USE SHALL AFFECT ANY NON-WAIVABLE STATUTORY RIGHTS THAT APPLY TO YOU. If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.

 
Indemnity

i.               You will defend, indemnify and hold IDWellness, its affiliates, directors, officers, agents, employees, and its licensors, suppliers, and Distributors harmless from any costs, damages, expenses, and liability caused by your use of the Service, your violation of these Terms, or your violation of any rights of a third party through use of the Service.
ii.              Assignment
These Terms, and any rights or licenses granted under these Terms, may not be transferred or assigned by you, but may be assigned by IDWellness without restriction. Any assignment attempted in violation of these Terms is void.
iii.            Claims
YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICE MUST COMMENCE WITHIN ONE YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, THAT CAUSE OF ACTION IS PERMANENTLY BARRED.

 

Governing Law
The terms will be governed by English Law and the exclusive jurisdiction of the Courts of England and Wales.

6.  Acceptance of Terms of Service

You have accepted these Terms of Use, which govern your use of our services. As used in these Terms of Service, our service means any of the services listed in [2.].
These Terms of Service, which include our Privacy Policy (www.id-wellness.com/privacy policy) govern your use of IDWellness services. By using, visiting or browsing IDWellness services, you accept and agree to these Terms of Service. If you do not agree to these Terms of service, do no use IDWellness services.

7.  Changes to Terms of Service

IDWellness may change these Terms of Service when necessary, including our Privacy Policy. We reserve the right to change these terms at any time. All changes to terms will be effective after the change is published on this page,  www.id-wellness.com/termsofservice. To keep up to date, you can check our terms on this page, www.id-wellness.com/termsofservice. It is your responsibility to review this Privacy Policy periodically for any changes.

8.      Privacy Policy

Our Privacy Policy is accessible at www.id-wellness.com/privacypolicy. This includes your communication preferences.

9.     Intellectual Property

IDWellness and all intellectual property rights in it including, but not limited to;  our website and its domains, any content on our website, website design, our name, branding and logo, IDWellness Membership, IDWellness Membership content, Bespoke Programmes, Gifting offerings, Corporate Wellness structure and content and any other entities that have implications of IDWellness creation or design are owned by IDWellness.

Intellectual property rights means rights such as: copyright, trademarks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind, whether or not they are registered or unregistered (anywhere in the world). We reserve all of our rights in any intellectual property in connection with these terms and conditions. This means, for example, that we remain owners of them and free to use them as we see fit.

You may not distribute, rent lease, lend, sell, transfer or sublicense any IDWellness services or any part of them, nor copy, decompile, reverse-engineer, dissembled, attempt to derive the source code of, modify or create derivative works of the our services or any part of it except to the extent as may be permitted by the licensing terms of any open sourced components included or any part of it and to the extent that the foregoing restrictions are not prohibited by applicable law.

10.     IDWellness Virtual Studio Membership Terms

IDWellness offers a variety of memberships. All our memberships include use of our on-demand platform of exclusive class content, access to our booklists and playlists. We reserve the right to modify, terminate or otherwise amend our offered membership plans.

Eligibility
You must be 18 years of age to become a member of the IDWellness Service. Individuals under the age of 18, may utilize the service only with the involvement of a parent or legal guardian, under such person’s account and otherwise subject to these Terms of Use.

Personal Use
The IDWellness Membership service and any content viewed through our service are for your personal and non-commercial use only. During your IDWellness membership, we grant you a limited, non-exclusive, non-transferable, license to access the IDWellness Membership service and view IDWellness content though the service. Except for the foregoing limited license, no right, title or interest shall be transferred to you. You agree not to use the service for public performances.

License
You agree to use the IDWellness Membership Service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. Except as explicitly authorized in these Terms of Service, you agree not to archive, download (other than through caching necessary for personal use), reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use content and information contained on or obtained from or through the IDWellness Membership Service without express written permission from IDWellness and its licensors. You also agree not to’ circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the IDWellness Membership Service; use any robot, spider, scraper or other automated means access the IDWellness Service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the IDWellness Membership service; insert any code or product or manipulate the content of the IDWellness Membership service in any way; or, use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the IDWellness Membership service, including any software viruses or any other computer code, files or programs.

Availability of service
You may view IDWellness content through the IDWellness service primarily within the country in which you have established your account and only in geographic locations where we offer our service and have licensed such IDWellness content. The content that may be available to watch will vary by geographic location. IDWellness technologies. THE NUMBER OF DEVICES ON WHICH YOU MAY SIMULTANEOUSLY WATCH IS LIMITED.

Service testing
We continually update the IDWellness Membership service, including the content library. In addition, we continually test various aspects of our service, including our website, user interfaces, service levels, plans, promotional features, availability of IDWellness content, delivery and pricing. We reserve the right to, and by using our service, you agree that we may, include you in or exclude you from these tests without notice. We reserve the right in our sole and absolute discretion to make changes from time to time and without notice in how we offer and operate our service.

Devices, quality and software
IDWellness Membership content is available for streaming via the compatible browsers. These are accessible via various devices, mainly; Mac, PC, Linex and Mobile Phone. Please check the browsers available on your devices before signing up to ensure their compatibility.

 The software we use for IDWellness Membership services is designed to enable viewing of IDWellness Membership content. We reserve the right to modify, update and change our use of software to provide IDWellness Membership content. By using our service, you agree to receive, without further notice or prompted, updated versions of the IDWellness Membership service and related third-party software. If you do not accept the foregoing terms, do not use our service. WE DO NOT TAKE RESPONSIBILITY OR OTHERWISE WARRANT THE PERFOMRANCE OF THE DEVICE USED, INCLUDING THE CONTINUING COMPATIBILITY OF THE DEVICE WITH OUR SERVICE. By using our service, you agree to look solely to the entity that manufactured and/or sold you the devce for any issues related to the device and its compatibility with the IDWellness Membership service.

The availability of IDWellness Membership content will change from time to time, and from country to country. The quality of the display of the IDWellness Membership content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your internet connection. Please check with your Internet provider for information on possible internet data usage charges. If the device you use to access the IDWellness Membership service is sold, lost or stolen, please deactivate the device. If you fail to log out or deactivate your device, subsequent users may access the IDWellness Membership service through your account and may be able to access your account information.

 We may terminate your use of our service, without compensation or notice if you are, or if we suspect that you are in violation of any of these Terms of Service.

 Passwords and Account Access
i.               Account controls - The member who created the IDWellness Membership account and whose payment method is charged to referred to here as the Account Owner. The Account Owner has access and control over the IDWellness Membership account. The Account Owner’s control is exercised through use of the Account Owner’s password and therefore to maintain exclusive control, the Account Owner should not reveal the password to anyone. In addition, if the Account Owner should wishes to prohibit the others from contacting IDWellness and potentially altering the Account Owner’s control, the Account Owner should not reveal the payment method details (e.g. the last four digits of their credit or debt card) associated with their account. You are responsible for updating and maintaining the truth and accuracy of the information you provide to us relating to your account.
ii.              Access – Be mindful of any communication requesting that you submit credit card or other account information. Providing information in response to these types of communications can result in identity theft. Always access your sensitive account information by going directly to the IDWellness website and not through a hyperlink in an email or any other electronic communication, even if it looks official. IDWellness reserves the right to place any account on hold anytime with or without notification to the member in order to protect itself from what it believes to be fraudulent activity. IDWellness is not obligated to credit or discount a membership for holds placed on the account by IDWellness.
iii.            Password – should you forget your password, you can reset via email.

Music
The IDWellness Membership service uses music. Our music is provided via a paid service from Epidemic Sounds. We have permission to use this music on our website for the IDWellness Membership service. We do not receive ant endorsements for this music.



Disclaimers of Warranties and Limitations on Liability For all IDWellness Membership

i.               IDWellness Membersip and all content and software associated there with, or any other features or functionalities associated with the IDWellness Membership service, are provided “as is” and “as available” with all faults and without warranty of any kind. IDWellness does not guarantee, represent, or warrant that your use of the IDWellness Membership service will be uninterrupted or error-free. IDWellness specifically disclaims liability for the use of applications, IDWellness Membership ready devices and IDWellness and IDWellness software (including their continuing compatibility with our service).
ii.              TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAWS, IN NO EVENT SHALL IDWELLNESS OR ISABEL DANIELLA LANCASTER BE LIABLE FOR (JOINTLY OR SEVERALLY) TO YOU FOR YOUR PERSONAL INJURY OR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER RESULTING IN YOUR ACCESS OR USE OF THE IDWELLNESS MEMBERSHIP SERVICE.

iv.             NOTHING IN THESE TERMS OF USE SHALL AFFECT ANY NON-WAIVABLE STATUTORY RIGHTS THAT APPLY TO YOU. Indemnity

viii.          In further consideration of being permitted to participate in the Activities, you may have against Isabel Daniella Lancaster, IDWellness, IDWellness Practitioners, and independent contractors that you may sustain as a result of participating in the Activities even if the Claim arises from the negligence these parties or anyone else. You agree to indemnify and hold harmless each of the following; Isabel Daniella Lancaster, IDWellness, IDWellness Practitioners, and independent contractors, from any loss, cost, or liability incurred in defending any Claim made by you or anyone making a Claim on your behalf, even if the Claim is alleged to or did result from the negligence of any of the following; Isabel Daniella Lancaster, IDWellness, IDWellness Practitioners, and independent contractors.
ix.             “Claim” includes but is not limited to any and all liabilities, claims, demands, expenses, fees, legal actions, rights of actions for damages, personal injury, mental suffering and distress, or death that you may suffer, your spouse, children or unborn child may suffer (including any legal fees or expenses) in connection with participation in any Activity.
x.              You, your heirs or legal representatives forever release, waive, discharge and covenant not to sue any Released Party for any Claim caused by any negligence or other acts of the following; Isabel Daniella Lancaster, IDWellness, IDWellness Practitioners, and independent contractors.
xi.             You acknowledge that you have carefully read this section of the Terms of Service and fully understand its contents. You voluntarily and knowingly agree to these Terms of Service. You are aware that by accepting these Terms of Service, you are giving up substantial rights, including your right to sue and certain legal rights to your heirs, next of kin, executors, administrators and assigns may have against any Released Party.

10.1

Membership renews month-to-month and automatically unless and until you cancel you membership or we terminate it. You must have internet access and provide us with a current, valid, accepted method of payment. This can be updated on our website via your account under “Payment” to use the IDWellness Membership service. We will bill the monthly to your payment method.

Cancellation
You must cancel your membership before it renews each month in order to avoid billing of the next months membership fees to your payment method.

Billing
i.               General - We operate on recurring billing. By starting your library membership and providing or designating a payment method, you authorize us to charge you a monthly membership fee at the current rate, and any other charges you may incur in connection with your use of the membership, such as taxes or possible transaction fees, to your payment method.
ii.              Price changes - We reserve the right to adjust price changes for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Any price changes to your service will take effect following an email notice to you.
iii.            Billing Cycle – the membership fee for our service will be billed at the beginning of the paying proportion of your membership and each month thereafter unless and until you cancel your membership. We automatically bill your payment method each month on the calendar day corresponding to the commencement of your paying membership. Membership fees are fully earned upon payment. We reserve the right to change the timing of our billing, in particular as indicated below, if your payment method has not successfully settled. In the event your paying membership began on a day not contained in a given month, we may bill your payment method on a day in the applicable month or such other day as we deem appropriate. For example, if you started your membership or became a paying member on January 31st, your next payment date is likely to be February 28th if paying monthly, and your payment method would be billed on that date. Your renewal date may change due to changes in your Membership. Visit our website and go to “Account”, followed by “Subscriptions” to see the commencement date for your next renewal period. We may authorise your payment method in anticipation of membership or service-related charges. As used in these Terms of Service, “billing” shall indicate a charge, debit or other payment clearance, as applicable, against your payment method. Unless otherwise stated differently, month or monthly refers to your billing cycle.
iv.             No Refunds – PAYMENTS ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS. Following any cancellation, however, you will continue to have access to your membership through to the end of your current billing period. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our members (“credits”). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance.

 

11. Private Services

Our private services offer tailored assistance both in person and online. These are any services we offer on a 1:1 or 2:1 basis.

Client Conduct
We request that you treat all IDWellness practitioners with courtesy and respect. IDWellness Practitioners shall be entitled to refuse to instruct or perform our modalities if you behave towards them in a manner which is discourteous, disrespectful, abusive or otherwise inappropriate. We reserve the right to withhold access to our services at our absolute discretion if you behave towards any IDWellness Practitioner in a manner which is discourteous, disrespectful or abusive or which we otherwise deem to be inappropriate.

Location
Your Home - We request that you provide IDWellness Practitioners with a safe, clean and appropriate location to perform our modalities. IDWellness Practitioners shall be entitled to refuse to instruct or perform our modalities if you have not provided a safe, clean and appropriate location for them. For safety reasons, the client is required to keep exits clear and unlocked. IDWellness Practitioners will notify our secretary on arrival and departure for safety reasons. If there is no signal, the IDWellness Practitioner will be required to use the your Wifi connection to ensure the secretary is kept up to date with the location of IDWellness Practitioners.

Pednor House
When using our services at Pednor House, you waive liability for any injury on the property. IDWellness is not responsible for any injury you may incur at Pednor House. We request you park in the designated areas. All props and mats are provided, however for sanitary reasons, please bring your own mat or towel to place over our mats.

Private Members Clubs and Training Centres
KX Life - Sessions held at KX Life follow the guidance and policy of the Club. Booking and payment are made through KX Life. KX Life terms of service and privacy policy therefore apply for any sessions held here.

Other Locations

When using other locations such as meeting in a coffee shop for a life coaching session, you waive liability for any injury on the property. IDWellness is not responsible for any injury you may incur at these locations.

Online
All online sessions are operated via Zoom. We will send out the information regarding the session (including date, time, possible props needed, possible playlist options and zoom links) upon booking (receival of payment) via email. We will also send out a reminder on the day of the session (including date, time, possible props needed, possible playlist options and zoom links).  All zoom links will include a password for the class for privacy purposes. We request you ensure you begin the meeting at the required start time, making time for updates and other possible software necessities and errors. The IDWellness Practitioner conducting the session will open the session 10-15 minutes before the start time of the session.

Lost, stolen or damaged goods
IDWellness Practitioners will not be held responsible for any lost, stolen or damaged goods.

Privacy Policy
Any information we collect via our consultation form or through any other means throughout the offering of our services is confidential and not given to any third parties. On exception, IDWellness will share data to the necessary sources if we feel the client or another person is at risk or serious injury or death. If you are of high profile, we request that you inform us prior to initial consultation so we can take the necessary precautions and carry out the necessary checks to ensure your safety and comfort.

Timings
We request you stick to the session timings agreed. IDWellness will accommodate as best as possible to give the best service.

Complimentary consultation

Each potential client is entitled to ONE complimentary consultation via phone or virtually via Zoom. Prior to the consultation, the client is required to read and agree to our Terms of Service and Privacy Policy. In the act of booking a consultation and following services, you are agreeing to our Terms of Service and Privacy Policy. If you do not agree with Our Terms of Service or Privacy Policy, do not use our services. The consultation form must be filled out and submitted online via our website at least 2 hours before the consultation.
Complimentary consultations are a maximum of 30 minutes. Consultations include a medical history overview, an insight to your goals, programme preferences, budget, availability, time zones, possible locations and anything else we need to know. Dependent on your goals and preferences, we curate an individual programme for you using the programmes we offer as framework.
Following the complimentary consultation, the client will be given an approximate quote. The client will receive a programme breakdown and pricing via email. In the same email we will include our Terms of Service and Privacy Policy. If the client chooses to go ahead with the suggested, they will move onto “Booking”.

Pricing and Additional costs
Pricing is subject to; length of session(s), travel time and costs (including parking and charges such as The Congestion Charge if applicable), time of day, social times, modality requested, props and materials required. For example, additional costs may be incurred if taxis or cars are involved (needed to transport equipment for Sound Healing). These costs will be integrated into the initial quote, however if changes or cancellations are made, pricing and costs may change.

13.     Classes, Masterclasses, Events and Workshops

Via Members Club, Studios or other third parties
Please refer to the specific class, masterclass, event or workshop to learn whether the class, masterclass, event or workshop complies by IDWellness terms and policies or the third party (Members Club, studio or alternate space’s) terms and policies. More information below for regular classes, masterclasses, events and workshops. For one-off classes, masterclasses, events and workshops, It is the clients responsibility to learn and adhere to terms and policies of company or business applicable.

For all classes, masterclasses, events and workshops via KX Life
Classes, Events and Workshops held at KX Life follow the guidance and policy of the Club. Booking and payment are made through KX Life. KX Life terms of service, privacy policy and club policy therefore apply for any sessions held here.

For In Person Group Classes at Pednor House
We operate on a 24 hour cancellation policy. In exceptional circumstances we may be able to make a partial or full refund upon our discretion. A no show is considered a cancellation. In the unlikely event IDWellness need to cancel a session, you will be fully refunded.

13.2 Online Group Classes
All online group classes are operated via Zoom. We will send out the information regarding the session (including date, time, possible props needed, possible playlist options and zoom links) upon booking (recieval of payment) via email. We will also send out a reminder on the day of the class (including date, time, possible props needed, possible playlist options and zoom links).  All zoom links will include a password for the class for privacy purposes. We request you ensure you begin the meeting at the required start time, making time for updates and other possible software necessities and errors. The IDWellness Practitioner conducting the session will open the session 10-15 minutes before the start time of the session.

Cancellation
We operate on a 12 hour cancellation policy. In exceptional circumstances we may be able to make a partial or full refund upon our discretion. A no show is considered a cancellation. In the unlikely event IDWellness need to cancel a session, you will be fully refunded.

Corporate Wellness is the wellness service we offer to companies and businesses.
Isabel Daniella Lancaster provides services through other wellness companies in corporate environments. These contracts are SEPARATE from the contracts, terms and policies listed for IDWellness below. When working for separate companies, Isabel Daniella Lancaster is working as an individual, separate from IDWellness.

Our terms of service and privacy policy INCLUDING our Waiver of Liability for all IDWellness Services and Disclaimers of Warranties and Limitations on Liability for al IDWellness services (4 and 5) APPLY TO ANY EMPLOYEE OR CONTRACTOR OF THE COMPANY WE PROVIDE OUR SERVICES TO UNDER IDWELLNESS.

IDWellness Corporate Programmes
IDWellness will provide a 60 minute complimentary consultation with the corporate client to discuss the needs of company, number of people and other factors to formulate a quote for the company. This may include live sessions either in person or online too. To book this service, the booking terms apply in 14.4). Once payment is made, IDWellness will send the necessary details needed to commence the programme, these include but are not limited to; programme timings and sessions, possible zoom links, possible access to IDWellness Membership, props and equipment needed and any other applicable information.

IDWellness Membership
Some Corporate Wellness Programmes will include the use of IDWellness Membership. For this service, the terms in [9 and 9.2] apply. Payment will be made as a whole for the services IDWellness provides. IDWellness will provide a discount code for the included access of all employees and contractors of the company.

Termination
If the client wishes to terminate the programme, the following applies;
i.               the sessions already completed will not be refunded.
ii.              any unused sessions will be refunded as long as they are outside of the cancellation policy window of 24 hours.
iii.            The client will incur an administration fee decided according to the absolute discretion of IDWellness.
iv.             IDWellness Membership will be immediately cancelled.
v.              Dependant on the time of termination, we may charge a fee for the materials provided as part of the programme such as any manuals or props.

15. Retreats

Booking
Booking is secured via a deposit. Please see the individual retreat for the deposit amount. The balance is due 12 weeks before the retreat. Payments are made via bank transfer.

Cancellation
If you need to cancel, your deposit is refundable up until 12 weeks before the retreat. The remaining balance is due 12 weeks prior to the retreat. Any cancellations after the remaining balance is paid can only be refunded or transferred if the space can be filled. All refunds issued will be less a £150 admin fee. If the retreat cannot go ahead due to Covid 19 any money paid is transferrable in full or refundable less the admin fee.

Travel Insurance
It is a condition of this holiday that you purchase travel insurance which includes cancellation insurance. None of us can predict unexpected events in our lives: illness, family emergencies, work conflicts, etc. By purchasing a comprehensive plan, you will ensure being covered in full should you need to cancel after the said cancellation period.

Travel
It is your responsibility to confirm your flight times with your airline before your outward and return journey as well as arrange insurance for hire cars if you chose to use one.

Changes and unusual events
The estimated schedule may be altered slightly to give you the best experience possible. If any of the activities are unsafe for any reason at that time, Issi Daniella reserves the right to make changes to the estimated schedule. For example, a storm on the day we are meant to go to the beach, plans will be altered.

Illness
If for any reason at all, Issi Daniella or another practitioner planned for a retreat or event becomes ill or unavailable, I will do my best replace them with a Practitioner of similar qualities and standards. Wherever possible you will be advised in advance of any alterations. Similarly, the alteration of some amenities or courses might take place due to maintenance work, mechanical faults, weather conditions, sickness or other situations outside our control.

Allergies and Intolerances
Information on allergies and intolerances are required 6 weeks (minimum) prior to the retreat to make the necessary amendments.

Excursions of Liability
The Waiver of Liability for all IDWellness Services and Disclaimers of Warranties and Limitations on Liability for al IDWellness services (4 and 5) apply to our retreat service. In addition, the following exclusions of liability apply on our retreats;

i.               Cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster,
technical problems to transport, staff cancellations or other events beyond our control.
ii.              Loss of, or damage to, personal property of participants. IDWellness (Issi Daniella) accepts no responsibility for loss or damage of personal possessions or valuables of the client during the retreat time. This is includes but is not limited to journeys from and to the clients home (possibly through various travel options such as airports) and excursions out of the villa.
